The Jury's Still Out: A Critical Look at Malpractice Reform William Sage, Margaret Thompson, Cynthia Gorman, Melissa King Center for American Progress, June 12, 2008 Authors William Sage and Margaret Thompson describe the many faults of the current medical liability system. Studies have shown that thousands of people are injured each year, yet few seek redress through the court system. Indeed, litigation provides limited recourse and has little effect on quality improvement or the prevention of future errors. Policy makers consistently push a set of reforms aimed at curbing litigation and lowering costs, but harmful and costly medical errors go unchecked.
More creative and comprehensive reforms are needed which more closely tie malpractice compensation to quality improvements. Common Good has been working with the Harvard School of Public Health to advance the health courts model, a system which would exepdite compensation, enhance predictability and promote safety. ยป article
